Under Penal Code § 1203.4, the court will allow a defendant who successfully completes probation to withdraw their guilty plea and have their case dismissed. All defendants who are granted probation on their case are entitled to this relief if they have successfully completed probation and are not on probation or parole in another case.
Getting an expungement in California state court requires filing an official petition with the court, serving the proper prosecutorial agency and attending an expungement hearing where arguments are made to the judge. Some jurisdictions will grant an expungement without a hearing, but most will not.
